The United States has since 1990 sponsored the EB-5 Program to stimulate the U.S. economy with job creation and capital investment with foreign investors. Some projects require direct investment in new business in the United States, while other foreign investors may assume a more passive role and still qualify under approved regional centers investments such as The Hudson Yards in Manhattan. Since the process involves applying for a conditional and permanent Green Card by the foreign investor, there are substantial tax issues that are faced by the EB-5 investor.
