A skilled communicator both in and outside the courtroom, Dan Davidson counsels clients facing high-stakes criminal matters, government investigations, and civil and criminal tax controversies.

Dan has advised individuals and a diverse array of businesses and non-profit entities facing the threat of criminal prosecution. In some of these matters, Dan successfully achieved non-public resolutions without any charges being brought against his clients. Dan has conducted internal investigations on behalf of a publicly traded company’s audit committee and a large, privately held business. He also participated in an investigation conducted on behalf of the Grievance Committee for the United States District Court, Southern District of New York. Dan regularly represents clients who receive grand jury subpoenas from U.S. Attorneys’ Offices and the Manhattan DA’s Office.

Dan is an experienced courtroom advocate, having appeared in court at all stages of criminal litigation, from arraignments to evidentiary hearings, trials, sentencings, and post-conviction relief. Dan has jury trial experience in federal and state court and, as a prosecutor, gained extensive experience appearing before grand juries in New York City. Dan has achieved sentences for clients that are well below the applicable U.S. Sentencing Guidelines ranges. Dan’s pro bono practice focuses on post-conviction advocacy, including motions for compassionate release and other options for sentence reduction.

In addition to frequently representing clients facing allegations of fraud, unreported income, and payroll tax violations, Dan has litigated civil tax disputes against the Department of Justice and foreign tax authorities. Dan also represents clients navigating New York City government ethics and lobbying laws enforced by the City’s Conflicts of Interest Board and Lobbying Bureau.

Prior to joining Kostelanetz in 2019, Dan served for three years as an Assistant District Attorney in the Brooklyn DA’s Office. There, he gained substantial trial experience, conducted numerous grand jury investigations, and negotiated hundreds of plea agreements.

Dan received his J.D. cum laude from New York University School of Law in 2016. While in law school, Dan was a semifinalist in the Marden Moot Court Competition and a summer associate at Fried, Frank, Harris, Shriver & Jacobson LLP. He also participated in NYU’s Washington, DC-based Legislative and Regulatory Process Clinic while interning at the U.S. Department of Justice, Office of Legal Policy. Dan graduated from Brown University in 2011 with degrees in music and political science.
